GENERAL RENTAL CONDITIONS

The service “bike rental" is provided by Viaggiare Curiosi, (hereinafter referred to as the lessor). The rental conditions are an integral part of the rental contract. By accepting the general terms and conditions, the hirer confirms that he/she has read and fully accepted the rental conditions.

1. Taking over the equipment

Before starting to use it, the hirer is required to check the correct functioning and safety of the bicycle, as well as to promptly notify any defects revealed. He declares that he has received sufficient guidance and has confidence to control the bike / ebike, including the brakes, the gears and battery range (for the ebike).

2. Responsibility of the the hirer

The hirer is required to treat the Bicycle with care and in accordance with the usual usage for vehicles of this type, as well as to observe all the requirements relating to use in order to avoid damage. The hirer is liable for any damage occurring during the rental period for the entire value of the bicycle (from € 500 to € 2,300). The hirer, on the other hand, is liable without limitation for damages that are intentional or resulting from gross negligence. The client's liability also includes costs for damages, such as appraisal costs, a decrease in the value of the bike or the costs of losing the rental.

3. Bicycle theft

The hirer is responsible for the secure closure of the bicycle using the padlock provided. In the event of theft during the rental period, the hirer is fully liable for the value of the bicycle, e.g. for the touring bike € 500 (five hundred/00), for E-bike € 2,500 (two thousand five hundred/00), even if the theft is not due to negligence or fault of the tenant. The hirer is responsible for all personal effects stored in the panniers or any personal items of the equipment mounted on the bicycle.

4. Insurance

The renter is required to have his own valid liability insurance. By signing the rental agreement, the renter confirms that he has adequately covered the risks associated with the use of the equipment. The equipment is not insured against theft or damage.

5. Helmets

For greater safety on the bicycle, the tenant is recommended to use a helmet. An approved helmet is provided free of charge upon delivery of the bicycle

6. Traffic rules

The traffic rules must be strictly observed! Every single violation will be seen as the client's responsibility. It is not allowed to use the equipment while under the influence of alcohol or drugs.

9. Security deposit

The lessor may require a credit card imprint, an identity document or a cheque as a deposit against loss, theft or damage to the equipment.

10. Applicable law

This contract is subject to Italian law. In the event of a dispute, in order to compare the points of view of the third parties and to enable them to find a solution to the dispute themselves, a mediator may be appointed by the parties or the judge beforehand.
